Ethical Issues & Dilemmas in Estate Planning

Attorneys who do estate planning face multiple issues as they serve one or more clients in preparing a plan. Amidst issues on conflicts of interest, joint representation, confidentiality and privilege, disclosure obligations, and fiduciary duties, the process can pose any number of ethical dilemmas. Lorraine Cavataio and Ned Reilly have successfully navigated these murky waters for over 20 years, drawing on their various credentials as well as their interpersonal skills that put clients at ease as they solve their problems. Lorraine and Ned will share insights on ethical dilemmas in estate planning with an emphasis on charitable beneficiary planning as part of the process.

This session has been approved for 1.5 Ethics CLE credit hours from The Missouri Bar, and 1.25 CFRE continuing education points.

About Our Speakers
Lorraine Cavataio is a shareholder in the law firm of Sandberg Phoenix & von Gontard P.C. Her practice focus is estate planning, estate and trust administration, litigation, business and real estate law. Lorraine’s extensive work in estate planning has earned her great respect in her field, evidenced in part by her past presidency and authorship on legal topics for the Illinois Institute of Continuing Legal Education. She is also a Fellow of the American College of Trust and Estate Counsel.

A dynamic speaker with charisma galore, Lorraine rises to leadership in most things she devotes attention to – including co-chairing the Women’s Committee at Sandberg Phoenix, founding the St. Clair Women’s Forum to support women and diversity in the workplace, and service over the years on the boards of the Greater Belleville Chamber of Commerce, the Leadership Council of Southwestern Illinois, Epilepsy Foundation of Greater Southern Illinois, Cardinal Glennon Children’s Hospital, Make-A-Wish Foundation, Big Brothers Big Sisters, and her grade-school alma mater Blessed Sacrament School. Her undergraduate degree is from University of Kansas and her law degree from Washington University in St. Louis.

Edward “Ned” Reilly joined Sandberg Phoenix in 2017 after more than three decades of practice in wealth planning, trusts and estates. He has counseled many multi-generational families, which calls for a careful approach to representation – addressing the individual’s needs and objectives, as well as those of his or her family. Ned is a member of the Missouri Bar Association, the Illinois State Bar Association, the American Bar Association and the Bar Association of Metropolitan St. Louis (Probate and Trust Law Steering Committee). He has been listed in The Best Lawyers in America in the Trusts and Estates practice category since 2005. Ned is an Adjunct Professor in the LL.M. program at Washington University School of Law, a Fellow of the American College of Trust and Estate Counsel and is an Articles Editor for The Tax Lawyer. Ned earned his B.A. from the University of Illinois, then his Juris Doctor and LL.M. in Taxation from Washington University School of Law.
